General Terms & Conditions of Contracting and Use 

Relating to: 

Azores Pro Travel and about our services and activities. This site is owned by the owner of Azores Pro Travel, identified by VAT: PT 217243827, with registered office in Ao Lugar 64, 9700-301 Altares, Açores, Portugal. 

  1. APPLICATION

1.1 These General Terms and Conditions apply to all visitors to the Azores Pro Travel website, www.azoresprotravel.com (hereinafter referred to as the “Site”) and to any other transaction of a commercial nature carried out through the Site’s online store. 

The navigation on the site, as well as the purchase of any product through it implies the acceptance of these General Conditions of Contractand Use by the User and the Client. 

Before ordering any product on our Site please read these Terms carefully and print or save a copy for future reference. Azores Pro Travel reserves the right to review and change the General Terms and Conditions at any time without notice, being certain that they comply with the provisions of Decree-Law 24/2014, of 17-02, with the changes introduced by Law 47/2014, of 28-07. 

 

  1. INFORMATION ON CONTENT

Article 4 of Decree-Law 24/2014, of 17-02, with the amendments introduced by Law 47/2014, of 28-07 

Reproduction, transfer, distribution or storage of the contents of the www.azoresprotravel.com website without prior written permission granted by Azores Pro Travel is prohibited for purposes other than strictly personal use. 

Every effort has been made to ensure that the information presented is free from typographical errors. Still, if these occur, Azores Pro Travel will proceed as soon as possible to the respective correction. Obvious errors such as price errors, calculation or typographical errors in offers, promotions, folders, brochures, catalogs, order confirmations, invoices and other written statements from Azores Pro Travel are not binding. 

The photographs of the products presented on the website are illustrative only. As such, Azores Pro Travel recommends that the Customer consult the detailed description of the product in order to obtain the complete information about their characteristics, as well as request more accurate information, if so 

 

  1. OFFER AND AGREEMENT

3.1 The offers and promotions contained on the Site do not imply any obligation. By completing your order on the Site, you are making a binding offer to purchase the product. All orders are subject to acceptance by Azores Pro Travel and the agreement between you and Azores Pro Travel will only be formalized when Azores Pro Travel begins compliance with the Contract. If the products ordered no longer market themselves or stock is ruptured, Azores Pro Travel will inform you of this fact and reject the order. If possible, Azores Pro Travel will propose in place other products of similar nature and quality. 

3.2 The prices shown are in euros. The availability of the products presented on the Site is limited to the existing stock at any given time. 

 

  1. PRICES, PAYMENT

Article 4 of Decree-Law 24/2014, of 17-02, with the amendments introduced by Law 47/2014, of 28-07 

4.1 The applicable prices are the prices of the products displayed on the Site. All products contain price indication with VAT in Euros. 

 

 4.2 Payments may be made by: 

  1. by Bank Transfer 
  1. by PayPal 
  1. by ATM References 
  1. by Credit Card 

 

4.3 In specific cases Azores Pro Travel may restrict payment only to Bank Transfer 

 

4.4 Bank Transfer 

After placing your order, you will receive a confirmation email that includes azores pro travel banking information, so you can proceed with the transfer. After completing the transfer, the Traveler will need to send an email to geral@azoresprotravel.com with proof or confirmation, mentioning the Customer Name and to what product and value for which the transfer is concerned. The bank information will be indicated at the end of the order on the Site.Your order will be processed as soon as we receive payment, if you choose the bank transfer. 

 

4.5 PayPal 

After completion of the order is started the payment procedure, being made the choice by this payment method, you will be forwarded to the PayPal page where you can confirm the purchase. 

4.6 ATM reference 

After completion of the order and started the payment procedure, being made the choice by this payment method, the customer will be made available to the customer the necessary references to make the payment. It should be added that the reference(s) will have a deadline for payment, after which Azores Pro Travel is not responsible for any changes in the price of the contracted service. 

4.7 Credit Card 

After completion of the order and the payment procedure started, being made the choice by this payment method, the customer will be made available to the customer the information necessary to make the payment. 

4.8 The order will be processed as soon as we receive confirmation of payment, in any of the modalities. 

 

  1. DISCOUNTS

5.1 The period of validity of the promotions presented is present in all product sheets, just click on “promotion info”, next to the promotion. 

 

 5.2 Promotional discounts will be made on condition that the order is finalized by the User, through checkout and paid, until the end of the announced period. 

5.3 Storing a product in the “shopping cart” does not guarantee the price or discount of the same, if it is not fulfilled the statin at the previous point. 

The following general conditions are an integral part of the travel programme presented on our website, constituting in the absence of an autonomous document the travel contract 

The information is binding on the agency unless cumulatively: 

  • The program expressly provides for it; 
  • Changes to it are negligible; 
  • The information of the change is provided to the traveller on a durable medium; 

These general conditions comply with the provisions of Decree-Law No. 17/2018 of March 8. 

The General Conditions for which is an Organized Travel or Related Travel Service contained in the program, the corresponding standard information sheets and the particular conditions contained in the travel documentation provided to the Traveler at the time of booking the trip are part of the travel contract binding on the parties. 

 

  1. ORGANIZATION

6.1 The organization of the trips included in this website and its commercialization is the responsibility of Azores Pro Travel, based in Ao Lugar 64, 9700-301 Altares, NIF 217243827, telephone: 295989108 (May include call rates to Portugal), email: geral@azoresprotravel.com . 

 

  1. REGISTRATION

At the time of registration, the Traveler must deposit 40% of the price of the service, settling the remaining 60% up to 21 days before the start of the service. If registration takes place 21 days or less from the start date of the service, the total price of the service must be paid at the time of registration. 

Azores Pro Travel reserves the right to cancel any registration whose payment has not been made under the above-mentioned conditions. Reservations are subject to obtaining the part of the suppliers the confirmation of all services. 

 

  1. Information under Law No. 144/2015 of September 8

Pursuant to Law No. 144/2015 of 8 September in its current wording, we inform you that the Traveler may resort to the following Alternative Consumer Dispute Resolution Entities: 

  1. Customer Provider of Travel and Tourism Agencies in www.provedorapavt.com;
     
  1. Portuguese Tourism Arbitration Commission in www.turismodeportugal.pt; 

 

  1. Complaints

9.1 Any non-conformity in the performance of a travel service included in the package travel contract must be communicated to the organiser or retailer travel agency in writing or otherwise appropriate as soon as such non-compliance occurs, i.e. without undue delay. 

 

9.2 The right to lodge claims for the purpose of reducing price or entitlement to compensation for lack of conformity of the travel services included in the package shall be prescribed within 2 years. 

 

  1. Luggage

10.1 The Traveler is obliged to complain to the entity providing the services (airline, transfer service, taxi, etc…) at the time of subtraction, deterioration or destruction of luggage. 

10.2 In international transport, in case of damage to the baggage, the claim must be made in writing to the carrier immediately after the damage has been verified, and no later than 7 days from its delivery. In case of the mere delay in the delivery of the luggage the claim must be made within 21 days from the date of delivery of the same. 

 

  1. Booking and Alteration Expenses

11.1 For each reservation, reserve expenses will be charged. 

 

11.2 Change Expenses: For each change (names, dates, type of apartment or room, travel, etc.) will be charged change expenses. Please note that acceptance of such changes depends on acceptance by the respective suppliers. 

 

  1. Documentation

12.1 The Traveler must have in good order his personal or family documentation (identity card, passport, military documentation, authorization for minors, visas, certificate of vaccines and others required). Azores Pro Travel declines any responsibility for the refusal to grant visas or the non-permission of entry to the Traveler in a foreign country; it is also the traveler’s account for any and all costs that such a situation entails. 

 

12.2 Travel in the European Union: 

  • Travelers (regardless of age) who travel within the European Union must have their civil identification document (Passport; B.I, Citizen Card); 
  • To obtain medical assistance, they must be holders of their European Health Insurance Card; 
  • Nationals of non-EU countries should consult specific information on the documentation necessary for travel to the embassies/consulates of the countries of origin; 

 

12.3 Travel outside the European Union: 

  • Travelers (regardless of age) who travel outside the European Union must have their civil id (passport) as well as the visa if necessary (obtain such information from Azores Pro Travel at the time of booking); 
  • Nationals of non-EU countries should consult specific information on the documentation necessary for travel to the embassies/consulates of the countries of origin; 

 

  1. Changes requested by the Traveler

13.1 Where the suppliers of the trip in question allow, where a Traveller, registered for a particular trip, wishes to change his/her registration for another trip or for the traveller departing on a different date, or other possible change, he shall pay the above-mentioned fee, as change costs. However, when the change takes place 21 days or less in advance of the date of departure of the trip, for which the Traveler is registered, or if the service providers do not accept the change, it is subject to the expenses and charges provided for in the clause “Termination of the Contract by the Traveler”. 

 

13.2 After the trip has begun, if requested to change the services contracted for reasons not attributable to Azores Pro Travel (e.g. extension of the nights of stay, flight change) the prices of the tourist services may not correspond to those published in the brochure that motivated the contracting. 

 

  1. Termination of the contract by the Agency

14.1 Where the journey is dependent on a minimum number of participants, the Agency reserves the right to cancel the package if the number of participants reached is less than the minimum. In such cases, the traveler will be informed in writing of the cancellation within: 

  • 20 days before the start of the package, in the case of trips lasting more than six days; 
  • 7 days before the start of the package, in the case of trips lasting two to six days; 
  • 48 hours before the start of the package, in the case of trips lasting less than two days. 

 

14.2 Before the start of the package, Azores Pro Travel may also terminate the contract if it is prevented from performing the contract due to unavoidable and exceptional circumstances. 

 

14.3 The termination of the travel contract by Azores Pro Travel under the above terms only entitlethes to the traveler the right to full refund of payments made within a maximum of 14 days after the termination of the travel contract 

 

  1. Change in price

15.1 The prices contained in the program are based on the costs of the services and exchange rates in force at the date of printing of the program and are so subject to changes (increase or price reduction) resulting from variations in the cost of transport or fuel, taxes, fees and exchange rate fluctuations up to 20 days prior to the date of travel. 

 

15.2 In case of price reduction Azores Pro Travel reserves the right to deduct from the reimbursement to be made to the traveler the corresponding administrative expenses, which at the request of the traveler will be justified. 

 

  1. Refunds

Once the journey has begun, no refund is due for services not used by the Traveler for reasons of force-force or for reasons attributable to the Traveler, unless reimbursed by the respective suppliers. The non-provision of services provided for in the travel program for causes attributable to Azores Pro Travel and if it is not possible to replace them with other equivalents, gives the Traveler the right to be reimbursed for the difference between the price of the services provided and that of those actually provided. 

 

  1. Termination of the contract by the traveler

17.1 The traveler is free to give up the trip at all times before the start of the trip. 

 

17.2 Such termination implies that it is liable for payment of all charges to which the commencing of the performance of the contract and its withdrawal from it are terminated. 

 

17.3 Where appropriate, the Traveller shall be reimbursed for the difference between the amount paid and the amounts referred to above. In this situation the refund will be made, deducting the charges. 

 

17.4 The traveler is also entitled to terminate the travel contract before the commencing of the travel contract without paying any termination fee, if there are unavoidable and exceptional circumstances at the place of destination or in its immediate proximity which considerably affect the performance of the same or the transport of passengers to the destination. The termination of the travel contract in this situation only entitles the traveller to full reimbursement of payments made. 

 

  1. Responsibility

18.1 Azores Pro Travel is responsible for the correct execution of all travel services included in the travel contract. 

 

18.2 In the case of package travel, Azores Pro Travel is liable to Travelers, even if the services must be performed by third parties and without prejudice to the right of return, in the general terms applicable. 

 

18.3 Azores Pro Travel responds jointly and severally with agencies or retail operators in the case of package travel 

 

18.4 In the other travel services, Azores Pro Travel is responsible for the correct issuance of accommodation and transport titles and also for the culpable choice of service providers, if these have not been suggested by the traveler. 

 

18.5 Azores Pro Travel acts as an intermediary in sales or reservations of single travel services and is responsible for the errors in issuing the respective securities, even in cases arising from technical deficiencies in the reservation systems attributable to them. 

 

18.6 Azores Pro Travel is responsible for any errors due to technical deficiencies in the booking system that are attributable to it and, if you have agreed to book an organized trip or travel services that are part of related travel services, for the errors made during the booking process. 

 

18.7 Azores Pro Travel is not responsible for errors in the booking that are attributable to the Traveler or that are caused by unavoidable and exceptional circumstances. 

 

  1. Assistance

19.1 In case of difficulties of the Traveler, or when for reasons not attributable to him, he cannot finish the package, Azores Pro Travel will provide the following assistance: 

  • providing adequate information on health services, local authorities and consular assistance; 
  • Assistance to the Traveler in the realization of distance communications and to find alternative travel solutions. 

 

19.2 If the difficulty behind the request for assistance was caused by the traveler deliberately or negligently, Azores Pro Travel may charge a fee in the amount of the costs in which it incurs as a result of the provision of such assistance. 

 

19.3 The cost limitation provided for above does not apply to persons with reduced mobility, their accompanying persons, pregnant women and unaccompanied children, or persons in need of specific medical care, provided that Azores Pro Travel has been notified of such specific needs at least 48 hours before the start of the package. 

 

  1. INSOLVENCY

In case of insolvency of Azores Pro Travel the traveler can use the Travel and Tourism Guarantee Fund and must use the Tourism of Portugal I.P entity responsible for its activation:

  1. VAT

The prices mentioned in the programs already reflect value added tax at the current rate that varies depending on the type of service contracted. 

 

  1. VALIDITY

The programs presented on our website are valid until the last return date of travel of each of them. 

NOTES 

  • These general conditions may be supplemented by any specific other conditions provided that they are duly agreed by the parties. 
  • Program prices may be based on the average quote of the currency of the service provider’s country of origin, so any relevant derivation of this currency may result in a revision of the travel prices in the terms of the “price change” clause. 
  • Due to the constant changes in the price of fuels on the prices charged, there may be a change in the fuel supplement inserted in the price under the terms of the “price change” clause. 
  • The categories of hotels and cruises presented in the programs follow the quality standards of the host country and may be changed by similar ones when for reasons unrelated to Azores Pro Travel it is not possible to maintain or confirm the existing reservation, and Azores Pro Travel is obliged to inform the Traveler as soon as he is aware of it. 

 

GENERAL INFORMATION 

ARRIVAL OR DEPARTURE TIMES 

Departure and arrival times are indicated at the local time of their country and according to the schedules of the respective airlines at the date of printing of the programmes and may therefore be subject to change. 

HOTELS/APARTMENTS 

Apartments – In case the accommodation is hired in an apartment, it is the responsibility of the Traveler to information the number of people who will occupy the apartment. In case more people are presented than those booked, the apartments may refuse entry. 

Hotels – The price shown is per person and is based on a double occupancy. Not all hotels have a triple room and an extra bed is usually placed that may not be of the same quality. In rooms equipped with two beds or double, the triple can consist only of those beds. The list of hotels and apartments contained in the programmes is indicative as well as their category that respects local criteria and classifications whose criteria are sometimes different from those used in Portugal. 

MEALS 

Unless otherwise stated, prices for Half Board and Full Board supplements do not include drinks. On arrivals at the hotel after 19h the first meal service will be breakfast the next day, on the last day and unless possibility of late check-out, the last service of the hotel will be breakfast. 

IN AND OUT TIMES 

The times and in and out on the first and last day will be set according to the first and last service. As a rule, non-binding rooms can be used from 14:00 on the day of arrival and must be left free until 12:00 on the day of departure. In the apartments the entrance is usually by 17:00 on the day of arrival and must be left free until 10:00 am on the day of departure. 

SPECIAL CONDITIONS FOR CHILDREN 

Given the diversity of conditions applied to children (destination and supplier) it is recommended to always question the special conditions that may apply to the trip in question.
